Welcome to Sukii. These Terms of Service (“Terms”) are an agreement between you and Advervia Advertising Agency (“Advervia,” “we,” “us,” “our”), the operator of the Sukii community directory and membership platform (“Sukii,” the “Platform”). By accessing Sukii, registering, or paying for a membership, you agree to these Terms. If you do not agree, please do not use the Platform.
1. About Sukii — a directory, not a marketplace
Sukii is a hyperlocal community directory and membership service that helps Capisnon (Capiz) businesses be found by local buyers, tourists, and overseas kababayan. Sukii does not sell products, hold inventory, process buyer payments, ship orders, or act as an escrow or marketplace. When a buyer is interested, they contact the seller directly (for example by Messenger or mobile) and any sale is solely between the buyer and the seller. The only payments Sukii collects are membership fees from sellers.
2. Definitions
- Member / Seller — a business that has registered and paid for a Sukii membership.
- Buyer / Visitor — anyone who browses the directory or contacts a seller.
- USID — your Unique Seller ID, issued when your membership is created.
- Content — information, photos, videos, logos, and other materials submitted to or produced for the Platform.
3. Eligibility
To register as a Seller you must be at least 18 years old, operate a legitimate business, and provide a valid DTI Business Name registration and a government-issued ID whose name matches your business registration. You agree that all information you provide is true, current, and complete, and that you have the authority to register the business.
4. Your account & USID
Your USID identifies your membership and is used to sign in to the Seller Portal and to access member-only community groups. Keep it confidential. You are responsible for activity under your USID. Notify us promptly of any unauthorised use.
5. Membership, fees & billing
- Memberships and current prices (including Sukii Listing and Sukii Premium, any promotional or founding rates, the 2-month split option, renewals, and loyalty discounts) are described on our Membership page.
- All membership payments are processed by our third-party payment provider, PayMongo. Sukii does not collect or store your card or wallet credentials.
- Your membership is created with a pending status and becomes active upon confirmed payment and our verification.
- Refunds and cancellations are governed by our Refund & Cancellation Policy.
6. Verification, approval & rejection
We review submitted documents to support community trust. We may approve, request more information, decline, or later revoke a membership or listing if information is inaccurate, cannot be verified, is ineligible, or violates these Terms. Verification supports trust but is not a guarantee of any seller’s products, conduct, or business outcomes (see our Disclaimer).
7. Member responsibilities
- List only lawful products and services you are authorised to sell, with accurate descriptions, pricing, and contact details.
- Respond to buyers honestly and fulfil your own sales, delivery, and after-sales obligations.
- Keep your listing and contact information up to date.
- Comply with all applicable laws, including consumer, tax, and business-permit requirements.
8. Prohibited items & conduct
You may not use Sukii to offer or promote illegal, counterfeit, stolen, recalled, or unsafe goods; regulated items you are not licensed to sell (e.g. firearms, drugs, certain wildlife, or financial schemes); adult or exploitative content; or anything that infringes others’ rights. You may not post false information, impersonate others, harass the community, scrape or misuse data, attempt to disrupt the Platform, or use Sukii to defraud buyers. We may remove content and suspend members who breach this section.
9. Content & intellectual property
You retain ownership of the original Content you submit (such as your business details and product photos). By submitting it, you grant Advervia a non-exclusive, royalty-free, worldwide licence to host, display, resize, and use that Content to operate and promote your listing and the Platform across our website and social channels. You confirm you own or have the rights to everything you submit and that it does not infringe any third party.
Creative materials we produce for you (for example videos, graphics, and designs) remain the intellectual property of Advervia; your active membership grants you a licence to use them to promote your business. The “Sukii” name, logo, and platform are owned by Advervia and may not be copied or used without permission.
10. Public directory
You understand and agree that the business information in your listing is published publicly so buyers can find and contact you. Do not include personal information you do not want shown publicly.
11. No responsibility for buyer–seller dealings
Because Sukii is a directory and not a party to any sale, we are not responsible for the quality, safety, legality, delivery, or outcome of any transaction between a buyer and a seller, or for any dispute between them. Each seller is solely responsible for their own products, services, and customer obligations.
12. Third-party services
Sukii relies on third-party services including PayMongo (payments), Google Workspace (hosting of forms, files, and data), and Meta/Facebook (community groups and pages). Your use of those services is also subject to their own terms and policies.
13. Suspension & termination
We may suspend or terminate a membership for breach of these Terms, non-payment, fraud, or conduct that harms the community, with or without notice depending on severity. You may stop using Sukii at any time; fees already paid are handled under the Refund & Cancellation Policy.
14. Disclaimers & limitation of liability
Sukii is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Advervia is not liable for indirect, incidental, or consequential losses, or for losses arising from buyer–seller transactions or third-party services. Our total liability for any claim relating to the Platform will not exceed the membership fees you paid to us in the twelve (12) months before the event giving rise to the claim. Nothing here limits liability that cannot be limited by law, including your non-waivable rights under the Consumer Act (RA 7394). Please also read our Disclaimer.
15. Indemnification
You agree to indemnify and hold Advervia harmless from claims, losses, and expenses arising out of your Content, your products or services, your dealings with buyers, or your breach of these Terms or of any law.
16. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
17. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above shows the current version. Material changes will be posted on this page; continued use after changes means you accept them.
18. Governing law & venue
These Terms are governed by the laws of the Republic of the Philippines. Any dispute that cannot be resolved amicably shall be submitted to the proper courts of Roxas City, Province of Capiz, to the exclusion of other venues, without prejudice to applicable consumer-protection forums.
